1. Introduction

Welcome to Om Market Stores, an online multivendor e-commerce platform operated by Omaimz Marketing Private Limited (“Company”, “we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Om Market Stores website, mobile application, and related services (“Platform”).

By accessing or using this Platform, whether as a buyer, seller, vendor, or visitor (“User”, “you”, “your”), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not access or use the Platform.


2. Definitions

  • Buyer / Customer: Any individual or entity purchasing products through the Platform.
  • Seller / Vendor: Any individual or business registered on the Platform to sell products.
  • Platform: The website, application, or any digital interface of Om Market Stores.
  • Products: Goods or services listed for sale on the Platform.
  • Order: A confirmed purchase request placed by a buyer.
  • Settlement: The process of remitting payments to vendors after deduction of applicable charges and commissions.

3. User Eligibility and Account Registration

  • Users must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872.
  • Sellers must hold valid business registrations (GST, PAN, bank account, etc.) as required by law.
  • Users must provide accurate, current, and complete information during account registration.
  • The Company reserves the right to suspend or terminate accounts found to be involved in fraudulent or unlawful activity.

4. Platform Role and Nature of Services

Om Market Stores acts as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000. 
The Platform facilitates transactions between buyers and sellers but does not own, produce, or sell the listed products. The Company is not responsible for the quality, safety, legality, or accuracy of products sold by third-party vendors.


5. Vendor Onboarding and Obligations

  • Vendors must provide valid KYC documentation and agree to the Platform’s policies.
  • Vendors shall ensure all product listings are accurate, lawful, and not misleading.
  • Vendors shall not list prohibited or restricted items under applicable Indian laws.
  • Vendors must fulfill all accepted orders promptly and maintain adequate inventory.
  • Vendors agree to indemnify the Company against any claims arising from defective or counterfeit goods.

6. Product Listings and Intellectual Property

  • Vendors are responsible for the content, images, and descriptions of their product listings.
  • Vendors must ensure that product images and branding do not infringe upon any third-party intellectual property rights.
  • Om Market Stores reserves the right to review, modify, or remove listings that violate platform policies or legal guidelines.

7. Order Processing and Delivery

  • An order placed by a buyer constitutes an offer to purchase. The order is deemed confirmed only after acceptance by the seller.
  • Vendors must ship orders within the stipulated dispatch time.
  • Buyers agree to provide accurate shipping details. The Platform and sellers are not liable for non-delivery due to incorrect or incomplete addresses.
  • Risk of loss passes to the buyer upon delivery.

8. Pricing, Payments, and Settlement

  • Product prices are set by vendors and must include all applicable taxes (GST, duties, etc.).
  • Om Market Stores shall deduct a 15% commission (plus applicable GST on commission) on every completed order.
  • Settlement of vendor payments shall occur within seven (7) working days after successful order delivery and confirmation, subject to deduction of applicable commissions, returns, chargebacks, or penalties.
  • All settlements will be processed electronically to the vendor’s registered bank account.

9. Returns, Refunds, and Disputes

  • Buyers may initiate return or refund requests in accordance with the Platform’s Return & Refund Policy.
  • Vendors are obligated to accept returns for defective, damaged, or incorrect items as per the applicable policy.
  • Refunds will be processed after successful verification of the returned item.
  • Disputes between buyers and sellers will be mediated by Om Market Stores; the Company’s decision shall be final and binding.

10. Commission, Fees, and Charges

  • The Platform charges a flat 15% commission on all vendor sales, excluding applicable taxes.
  • Additional fees may apply for promotional services, logistics, or third-party integrations.
  • The Company reserves the right to revise commission rates with prior notice to vendors.

11. Prohibited Activities

Users shall not:

  • Use the Platform for unlawful, fraudulent, or deceptive purposes.
  • Violate any intellectual property or proprietary rights.
  • Attempt to gain unauthorized access to the Platform or user data.
  • Post obscene, defamatory, or misleading content.
  • Manipulate transaction prices or feedback mechanisms.

12. Limitation of Liability

Om Market Stores and Omaimz Marketing Private Limited shall not be liable for:

  • Any indirect, incidental, or consequential damages;
  • Product defects, quality issues, or delivery delays caused by vendors;
  • Loss of profits, goodwill, or data.

The Company’s total liability, under any circumstances, shall not exceed the total amount of commission received for the specific transaction giving rise to such liability.


13. Intellectual Property Rights

All content, trademarks, logos, and service marks displayed on the Platform are the property of Omaimz Marketing Private Limited or its licensors. 
No User shall use, reproduce, or distribute any such materials without prior written consent.


14. Termination and Suspension

The Company reserves the right to suspend or terminate any account at its discretion, without prior notice, for reasons including but not limited to:

  • Policy violation
  • Fraudulent activity
  • Misuse of Platform
  • Repeated customer complaints

15. Privacy and Data Protection

All personal and transactional information collected on the Platform will be handled in accordance with our Privacy Policy, which complies with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.


16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. 
Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.


17. Amendments

Om Market Stores reserves the right to modify or update these Terms at any time without prior notice. Continued use of the Platform constitutes acceptance of the revised Terms.
